Terms of Use

These terms & conditions, along with our Cookie Policy and Privacy Policy make up the Terms of Use for this site.

If you use www.encast.eu (the “Site”), this means you accept all these Terms of Use and you agree to comply with them. If you do not agree with any of these terms or conditions, then you must not use the site.

Age Limits

You must be 18 or older to use this site yourself.

If you are between 16 – 18 you can have a profile and use this site but only under the supervision of a responsible adult who should set up the profile and apply to castings on your behalf.

We do not accept any profiles/actors under 16 and do not post jobs for actors under 16. For more on this, see our help page on kids on enCAST.

Your Account and Password

If you join on the site, you will choose a username and password which you must keep confidential and not disclose to any third party.

If you know, or suspect, that anyone other than you knows your username or password, you must promptly tell us so we can secure your account.

We reserve the right to block any user we suspect of having their account used by an unauthorised person.

Subscriptions, Refunds & Cancellations

Basic use of the site is free. However, you can subscribe to the site to have access to additional features.

Payment is made securely through one of these third party companies: Stripe, Paddle*, or MyCommerce. These systems are fully PCI compliant and your data is securely encrypted at every stage. They are also fully GDPR compliant.

Note that enCAST does not collect, nor hold, any financial details you might submit, e.g. your credit card number or billing address, etc. although these may be held securely by the processing company.

Payment is by subscription meaning that paying users of our site make recurring payments (which is stated clearly on the payment form). Payments are non-refundable after 48 hours, or if any of the additional site features have been used within that time.

In addition, note that we have to charge €5 to make a refund in order to cover the associated costs charged by the credit card processing companies for this.

You can cancel your subscription at any time with no obligation or penalty. When you cancel your Pro-Actor status will remain active until the subscription period ends.

* Where payment is made through Paddle, the order process is conducted by our online reseller Paddle.com who are the Merchant of Record for all these orders. Paddle provides all customer service inquiries and handles returns for these orders.

enCAST is the owner or the licensee of all intellectual property rights on the Site relating to content generated by enCAST, and those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You must own the copyright, or have the licence to use, any content (including any media such as images, soundfiles, videoclips, etc) you upload to the site. You warrant that any such contribution complies with these requirements and you will be liable to enCAST and indemnify enCAST for any breach of that warranty.

enCAST will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other Site user. Furthermore, enCAST has the right to remove any content you upload to the Site if, in our opinion, it does not comply with the standards set out in these Terms of Use or breaches our standards.

Viruses & Security

The Site has an SSL certificate. This means that any information you send to, or receive from, the site is encrypted end-to-end and cannot be read except by you and the server.

The security of the Site and your personal information is extremely important to us and we do everything we reasonably can to make sure sensitive information is encrypted and you have control about what information you display here. However, remember that even security services get hacked and no system is 100% infallible. So while we do what we can, we cannot guarantee its total security.

Whilst we take all reasonable precautions and employ protective software and systems, enCAST is not able to guarantee that the Site will be secure or free from bugs or viruses. You are thus responsible for configuring your information technology, computer programmes and platform in order to access the Site. You should use your own virus protection software.

You must not misuse the Site by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site. You must not attack the Site via a denial-of-service (DOS) attack or a distributed denial-of service (DOS) attack. We will report any such breach to the relevant law enforcement authorities and will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site will cease immediately.

Linking to the Site

You may link to the Site provided you do so in a way that is fair and legal and does not damage enCAST’s reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on enCAST’s part where none exists. We reserves the right to withdraw linking permission without notice. If you wish to make any use of content on the Site other than as set out above, please contact us.

Where the Site contains links to other websites and resources provided by third parties, these links are provided for your information only. enCAST has no control over the contents of those websites or resources.

enCAST assumes no responsibility for the content of websites to which the Site links or is linked. Such links should not be interpreted as endorsement by Invest Europe of those linked websites and enCAST will not be liable for any loss or damage that may arise from your use of such linked websites.

No Reliance on Information

The content on the Site is provided for general information purposes only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the Site.

Although enCAST makes reasonable efforts to update the information on the Site, we do not give any representations, warranties or guarantees, whether express or implied, that the content on the Site is accurate, complete or up-to-date.

Limitation of Liability

enCAST will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable, arising under or in connection with (i) use of, or inability to use, the Site and (ii) use of or reliance on any content displayed on the Site.

enCAST will not be liable for (i) loss of profits, sales, business, or revenue, (ii) business interruption, (iii) loss of anticipated savings, (iv) loss of business opportunity, goodwill or reputation and, more generally (v) any indirect or consequential loss or damage.

enCAST will not be liable for any loss or damage caused by a virus, distributed denial-of-service (DOS) attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Site or to your downloading of any content on it, or on any website linked to it.

Changes to these Terms of Use

We reserve the right to update or change our Terms of Use at any time and you should check this page periodically.

Your continued use of this site after we post any modifications on this page will constitute your acknowledgement of the modifications and your consent to abide and be bound by these terms. If we make any material changes to this policy, we will notify you either through the email address you have provided us, or by placing a prominent notice on our website.
